The Flowering Farmhouse – Terms of Use

Welcome to The Flowering Farmhouse and The Dahlia Patch (together, “Company,” “we,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our websites, online courses, membership communities, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you should not use our Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using our Services, you represent and warrant that you meet these requirements.

2. Intellectual Property

All content provided through our Services—including text, images, videos, graphics, course materials, and logos—is owned by or licensed to The Flowering Farmhouse LLC. You may not copy, distribute, reproduce, or create derivative works without our prior written consent. You may use provided materials solely for your personal, non-commercial use unless otherwise permitted in writing.

3. User Conduct

By using our Services, you agree not to:

  • Violate any applicable laws or regulations.
  • Share your account access, login credentials, or purchased materials with others.
  • Use our Services to distribute spam, malware, or unlawful content.
  • Infringe upon or misappropriate the intellectual property rights of others or of the Company.

We reserve the right to suspend or terminate your access for violations of these Terms.

4. Payments and Refunds

If you purchase a course, membership, or product through our Services, you agree to pay the listed price and any applicable taxes or fees.

  • Digital Products (Mini Courses, Online Content): Due to the nature of digital content, all sales are final. No refunds are available once a course or digital product is purchased.
  • Physical Products (Dahlia Tubers): We ship only our healthiest and highest-quality tubers. Due to extreme weather, pest pressure, and growing conditions beyond our control, we cannot guarantee the performance of your tuber or plant’s growth. Any issues with your order must be reported to hello@thefloweringfarmhouse.com within 7 days of receiving your order. Please include your order number and photographs showing the issue. It is important that you open and inspect your order upon receipt. We are not responsible for ongoing storage after delivery. After 7 days, all tuber sales are final.
  • Refund eligibility will always be clearly stated on the specific product or course sales page.

5. Affiliate Program

Participation in our Affiliate/Referral Partner Program is governed by a separate agreement. These Terms apply to all site users, while the Affiliate Agreement applies specifically to partners promoting our offerings.

6. Disclaimers

Our Services are provided “as is” without warranties of any kind, express or implied. We do not guarantee specific results from using our Services. Gardening and flower farming involve risks outside of our control (such as weather, pests, and soil conditions).

7. Limitation of Liability

To the fullest extent permitted by law, The Flowering Farmhouse LLC will not be liable for indirect, incidental, or consequential damages, or for lost profits, arising from your use of the Services. Our total liability will not exceed the amount you paid to us for the applicable Service.

8. Indemnification

You agree to indemnify and hold harmless The Flowering Farmhouse LLC, its owners, employees, and contractors from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts located in Hood River County, Oregon.

10. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
